IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS
This Notice shall satisfy the above-cited two separate but related procedural notification requirements.
REQUEST FOR RELEASE OF FUNDS
On or about 2/21/2012 Crockett County will submit a request to the Texas Department of Agriculture - Office of Rural Affairs (TDA-ORA) for the release of Texas Community Development Block Grant funds under Title I of the Housing and Community Development act of 1974 (P.L. 93-383), as amended, to undertake a Sewer System Improvements project known as 711149, to install 2,400 LF of 6" sewer line, 6 manholes, 34 service reconnects, pavement replacement, and all associated appurtenances at 3rd St from alley between Ave E and Ave F to Ave D, Ave D from Fairview Drive to 70 LF north of Young St, Young St from Ave D to eastern end of Young St, RR 2398 from Ave J to 1,800 LF southwest of Ave J, in Ozona. Alternately, install an additional 700 LF of sewer line on Ave J from 11th St to Sheffield Rd. Crockett County has been awarded $200,000 in grant funds and shall contribute $65,000 in match funds.
FINDING OF NO SIGNIFICANT IMPACT
Crockett County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Crockett County Courthouse, 909 Avenue D, Ozona, Texas 76943 and may be examined or copied weekdays from 8:00 AM to 5:00 PM.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Office of the County Judge. The local comment period begins on 2/2/2012 and ends on 2/17/2012. All comments received by 2/17/2012 will be considered by Crockett County prior to authorizing submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing.
RELEASE OF FUNDS
Crockett County certifies to TDA-ORA that Fred Deaton in his capacity as County Judge consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. TDA-ORA approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Crockett County to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
TDA-ORA will consider objections to its release of funds and Crockett County certification received by 3/7/2012 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of Crockett County approved by TDA-ORA (b) Crockett County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by TDA-ORA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. The anticipated state comment period is 2/21/2012 through 3/7/2012. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to The Texas Department of Agriculture - Office of Rural Affairs at P.O. Box 12847, Austin, Texas 78711. Potential objectors should contact TDA-ORA to verify the actual last day of the objection period.

Final Notice and Public Explanation of a Proposed Activity
in a 100-Year Floodplain
To: All interested Agencies, Groups and Individuals on 1/18/2012: This is to give notice that the Crockett County has conducted an evaluation as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to determine the potential affect that its activity in the floodplain and wetland will have on the human environment for Community Development Block Grant Program under contract 711149. Crockett County's Sewer System Improvements proposes to install 2,400 LF of 6" PVC sewer line, 6 manholes, 34 service reconnects, pavement replacement, and all associated appurtenances at 3rd St from alley between Ave E and Ave F to Ave D, Ave D from Fairview Drive to 70 LF north of Young St, Young St from Ave D to eastern end of Young St, RR 2398 from Ave J to 1,800 LF southwest of Ave J; alternately, install an additional 700 LF of sewer line on Ave J from 11th St to Sheffield Rd, in Ozona, Crockett County. The project shall include activities within less than 1 acre of the 100-year floodplain. Crockett County has considered a reduction in scope, alternate locations, and no action to minimize adverse impacts and to restore and preserve natural and beneficial values. This project shall comply with state and local floodplain protection procedures. Crockett County has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative. Environmental files are available for public inspection, review and copying upon request during regular business hours at the County Courthouse. This activity will have no significant impact on the environment for the following reasons: The project involves rehabilitating existing infrastructure, there shall be no significant increase to impervious surface, and best management practices shall be employed during construction. The primary purposes for this notice include (1) People who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas; (2) An adequate public notice program can be an important public educational tool to disseminate information about floodplains and facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas; and (3) As a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk. Notice of Application for Oil & Gas Waste Disposal Well Permit
El Paso E&P Company, LP (PO Box 2511, Houston, TX 77002) is applying to the Railroad Commission of Texas for a permit of produced salt water or other oil and gas waste by injection into a porous formation not productive of oil or gas. The applicant proposes to inject fluid into the Clearfork Formation, University 44-2 SWD Lease, Well Number 1. The proposed disposal well is located 25.3 miles Northeast of Ozona, in the Lin (Wolfcamp) Field, in Crockett County. The waste water will be injected into strata in the subsurface depth interval from 4,350 to 4,550 feet. LEGAL AUTHORITY: Chapter 27 of the Texas Water Code, as amended, Title 3 of the Texas Natural Resources Code, as amended, and the Statewide Rules of the Oil and Gas Division of the Railroad Commission of Texas.
